Terms of Use (End-User License Agreement)

This page has two parts. Part 1 covers your use of the ParrotSense app and website. Part 2 is the license agreement for the app, including the terms Apple requires.

Part 1: Terms of Use

These Terms of Use ("Terms") are an agreement between you and Fourth Density Ventures LLC ("we," "our," or "us"). They govern your use of the ParrotSense mobile application and website (the "Service"). By using the Service, you agree to these Terms. If you do not agree, please do not use the Service. Your use of the app is also subject to our End-User License Agreement and Privacy Policy.

1. What ParrotSense is

ParrotSense uses artificial intelligence to interpret companion bird vocalizations, together with what you report about your bird. It provides behavioral interpretations for informational and educational purposes, including a likely signal, supporting reasoning, and a confidence level. It also provides health logs, diet guidance, a fresh-mix builder and safety information (such as checks for foods and household hazards), for the same informational and educational purposes.

2. Not professional advice

ParrotSense is not a substitute for care from an avian veterinarian or a qualified animal-behavior professional, and it does not diagnose medical or behavioral conditions. Interpretations may be incomplete or incorrect. Birds hide illness, so a calm-sounding result does not mean your bird is well. Do not rely on the Service to assess whether an animal is dangerous. Never use the Service with wild, unknown, or aggressive animals, and always prioritize safety. If your bird shows signs of distress, illness, or aggression, consult a qualified professional.

Talk to your avian veterinarian before you change your bird's diet. The fresh-mix builder does not make a complete diet. If your bird may have eaten or breathed something toxic, or seems unwell, contact your avian veterinarian, an emergency clinic, or an animal poison control service right away.

3. Subscriptions & billing

• Premium features require an auto-renewable subscription: $7.99/month or $49.99/year, each beginning with a 3-day free trial. The free trial applies once per Apple ID.
• Analysis includes a daily allowance, which resets each day.
• Payment is charged to your Apple ID at confirmation of purchase. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period.
• Manage or cancel your subscription in Settings › Apple ID › Subscriptions. Purchases are processed by Apple and are subject to Apple's terms.

4. Acceptable use

You agree not to misuse the Service, including attempting to disrupt or reverse-engineer it, submitting unlawful content, or using it in violation of applicable law. You are responsible for the content you submit.

5. Intellectual property

The Service, including its software, design, and content, is owned by us or our licensors and is protected by law. These Terms do not grant you any rights except the limited license described in the EULA.

6. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including fitness for a particular purpose and accuracy of interpretations.

7. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, or consequential damages, or for any decision made in reliance on an interpretation provided by the Service.

8. Changes

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

Part 2: End-User License Agreement

This End-User License Agreement ("EULA") is a legal agreement between you and Fourth Density Ventures LLC ("we," "our," or "us") for the ParrotSense application and any updates (the "Licensed Application"). By downloading or using the Licensed Application, you agree to this EULA. This EULA is entered into between you and us only, and not with Apple.

1. License grant

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Licensed Application on any Apple-branded device that you own or control, as permitted by the App Store Terms of Service, solely for your personal, non-commercial use.

2. Restrictions

You may not: copy (except as permitted by this license), decompile, reverse-engineer, disassemble, attempt to derive the source code of, modify, or create derivative works of the Licensed Application; rent, lease, lend, sell, redistribute, or sublicense it; or remove any proprietary notices.

3. Ownership

The Licensed Application is licensed, not sold, to you. We and our licensors retain all right, title, and interest in and to the Licensed Application, including all intellectual property rights.

4. Consent to data use

You agree that we may collect and use technical and related information as described in our Privacy Policy to provide and improve the Licensed Application.

5. Nature of the service

The Licensed Application provides AI-generated behavioral interpretations, health logs, diet guidance, a fresh-mix builder and safety information (such as checks for foods and household hazards) for informational and educational purposes only. None of it is a diagnosis or a substitute for advice from your avian veterinarian. Talk to your avian veterinarian before you change your bird's diet, and contact your avian veterinarian, an emergency clinic, or an animal poison control service right away if your bird may have eaten or breathed something toxic or seems unwell. 6. Termination

This EULA is effective until terminated. Your rights under it end automatically if you fail to comply with any of its terms. Upon termination, you must stop using the Licensed Application and delete all copies.

7. Apple-specific terms

• This EULA is between you and us only. Apple is not responsible for the Licensed Application or its content.
• Apple has no obligation to furnish any maintenance and support services for the Licensed Application. We are solely responsible for support, as described on our Support page.
• In the event of any failure of the Licensed Application to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation, and any other claims, losses, liabilities, damages, costs, or expenses attributable to a warranty failure are our responsibility.
• We, not Apple, are responsible for addressing any claims by you or a third party relating to the Licensed Application, including product-liability claims, claims that it fails to conform to legal or regulatory requirements, and claims under consumer-protection or similar laws.
• We, not Apple, are responsible for investigating and resolving any third-party claim that the Licensed Application or your use of it infringes intellectual-property rights.
• You represent that you are not located in a country subject to a U.S. Government embargo or designated as "terrorist-supporting," and that you are not on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of this EULA and, upon your acceptance, will have the right to enforce it against you.

8. Disclaimer & limitation of liability

The Licensed Application is provided "as is" without warranty of any kind. To the maximum extent permitted by law, we will not be liable for any indirect, incidental, or consequential damages arising from your use of the Licensed Application.
